Aucamp Scholtz Lubbe weer ‘n keer vereer!

sakekamerDie Helderberg Afrikaanse Sakekamer het by ‘n glansgeleentheid op 24 November 2012 aan ons sy toekenning van Sakeonderneming van die Jaar (Professionele Sake) 2011/2012 gemaak.  Die toekenning verleen erkenning aan ons firma vir die uitstaande gehalte van professionele dienste wat ons aan ‘n wye verskeidenheid van kliënte lewer asook ons gemeenskapsbetrokkenheid, en bevestig die leidende rol wat ons firma as ‘n besigheid in die Helderberg vertolk.

Dit is die tweede keer dat hierdie eer ons te beurt val en hierop is ons sommer baie trots!  In 2010 is die toekenning vir die eerste keer gemaak en ons het dit toe ontvang toe ons nog as BGR Aucamp Scholtz besigheid gedoen het. By daardie geleentheid het ons gesê dat ons nie alleen ‘n professionele markleier wil wees en bly nie maar dat ons ook die bakens van gehaltedienste en kliënteverhoudinge verder wil uitskuif. Ons glo dat ons hierdie onderneming gestand gedoen het maar besef ook dat ons steeds beter kan vaar en beskou dit as ‘n uitdaging vir die toekoms. Die toekenning van hierdie jaar sal dan ook as verdere inspirasie dien vir ons firma en al sy personeel om met ywer en toewyding die pad vorentoe aan te pak.

Annual returns of companies and close corporations

Clients are reminded of the requirements relating to the submission of annual returns, and the new procedure for re-instatements that must be followed as from 1 November 2012.

An annual return is a summary of the most relevant information pertaining to a company and close corporation. By lodging annual returns companies and close corporations ensure that the Companies and Intellectual Property Commission (CIPC) is in possession of the latest information. It also confirms that the entity is still in business or will be doing business in the near future.

All companies (including external companies) and close corporations are required by law to lodge their annual returns with CIPC within a certain period of time every year. An annual return is a statutory return in terms of the Companies and Close Corporations Acts and therefore MUST be complied with.

To submit an annual return the following forms need to be completed:
·    CoR30.1 (Annual Return) and;
·    CoR30.2 (Financial Accountability Supplement)

Completion of these forms requires the disclosure to the CIPC of certain information about the entity. This information varies, from details such as the number of persons employed, to the particulars of the person primarily responsible for recording day-to-day financial transactions and maintaining the financial records of the business. To submit annual returns on behalf of our clients we require them to provide the necessary information to us, should we not already have access to this information.

Failure to file an annual return within the prescribed time period will result in the CIPC assuming that the company or close corporation is not doing business or is not intending to do business in the near future, and is therefore inactive. This will lead to deregistration of the entity, which has the legal effect that the juristic personality is withdrawn and the entity ceases to exist.  In this event the property of the entity becomes “ownerless” and might be vested in the state unless the entity is re-instated.

It should be noted, however, that the CIPC will no longer re-instate a company or close corporation based solely on a statement that it is in business, or will be in business in the near future. Re-instatements are reserved for entities which can prove that they were in business at the time of deregistration, or have outstanding assets and/or liabilities which must be transferred or liquidated.

The CIPC’s Practice Note 6 of 2012, issued in accordance with the regulations under the Companies Act, 2008, details the requirements for a re-instatement application, effective as from 1 November 2012. Regardless of the cause or date of deregistration, an application must be submitted on an original signed form CoR40.5, and must be accompanied by the following documentation:

1.    Certified ID copy of the applicant  (director/member);
2.    Certified ID copy of the customer filing the application;
3.    Deed search (reflecting ownership, or not, of immovable property);
4.    Letters from National Treasury and the Department of Public Works, indicating these such departments have no objection to re-instatement, if it has immovable property;
5.    Advertisement in a local newspaper giving 21 days’ notice of  proposed application for re-instatement;
6.    Affidavit indicating the reasons for the non-filing of annual returns, if deregistration was due to non-compliance in relation to annual returns;
7.    Affidavit indicating the reason for the original request for deregistration, if the company or close corporation itself applied for         deregistration; and
8.    Sufficient documentary proof indicating that the company or close corporation was in business or that it had any outstanding assets or liabilities (e.g. property, intellectual property rights) at the time of deregistration.

On successful processing of the re-instatement application, all outstanding annual returns must be filed in order to complete the process.

It is clear from the above overview that the new system will be more administratively demanding and may lead to an additional fee in order to comply with the relevant legislation.

Aucamp Scholtz Lubbe honoured once again!

sakekamerAt a gala event on 24 November 2012 we received the Helderberg Afrikaans Chamber of Commerce’s Business Enterprise of the Year (Professional Business) 2011/2012 award. The award accords recognition to our firm for the outstanding quality of professional services rendered to a wide variety of clients, as well as to our community involvement, and confirms the leading role played by our firm as a business in the Helderberg.

It is the second time that this honour comes our way and this is a source of much pride! In 2010 the award was made for the first time, and we received it while still doing business as BGR Aucamp Scholtz. On that occasion we said that it was our desire to be and to remain a professional market leader and to further extend the beacons of quality services and customer relationships. We believe that we have lived up to this commitment but also realise that we can still improve. We regard this as a challenge for the future. The award received this year will serve as further inspiration to our firm and all its staff to tackle the road ahead with zeal and dedication.

UIF contributions: Income threshold increased

It is brought to the attention of clients that the prescribed maximum remuneration in respect of  UIF contributions has been increased with effect from 1 October 2012, as reflected in the following table:

  •     R 149 736 to R178 464 per annum, or
  •     R 12 478 to R 14 872 per month, or
  •     R 5 759,08 to R 6 864 bimonthly, or
  •     R 2 879,53 to R 3 432 per week.

Note that these adjustments do not affect the employee and employer contributions to the UIF.

Please ensure that this calculation is changed in your salary system as from October 2012.

Movember – maand van die snorre

Die manlike personeel van ons firma het pas weer hul deel gedoen ten bate van die bestryding van daardie kankers wat spesifiek die manlike geslag aantas.  Gedurende November het ons, as deel van die wêreldwye Movember-beweging se aksies in hierdie verband, snorre gegroei  om sodoende ons ondersteuning te toon en geld in te samel vir programme wat deur Movember en die Kankervereniging van Suid-Afrika (KANSA) bedryf word. Ons het daarin geslaag om R6 744 in te samel en glo dat, hoewel dit maar ‘n druppel in die emmer is, elke druppel tel om hierdie grootse poging se invloed te laat geld.

A dashing affair

dashingaffairOn the 9th of November we celebrated the end of yet another prosperous, challenging, exciting and rewarding year when we held our end-of-year staff function at the Stardust Theatrical Restaurant in Rondebosch, Cape Town.

The evening was filled with good food, good company and lively conversation, but most of all it was the sounds of the ever popular hits of ABBA, Michael Bublé, and a long list of classical favourites that put everyone in a nostalgic, and sometimes silly mood.  So much so that some of us simply had to take center stage!

In more serious mode we were honoured to present long service awards to two of our staff, Wilma Perold and Marietjie Schmidt, who respectively have completed 10 and 5 years of employment with the firm.

The evening turned out to be quite a dashing affair that was thoroughly enjoyed and will certainly not be forgotten soon.

Nuus uit personeelgeledere

Dit is altyd vir ons lekker om inligting oor personeel met ons kliënte te deel, gesien die feit dat u gereeld met hulle kontak het.

Ons glo dat u ook saam met ons hartseer is as individue wat u leer ken het ons diens verlaat, maar dat u ook geïnteresseerd is in die nuwe aanstellings wat ons maak.

Nuut op die toneel
mariskaMariska Bloemhof  het op 1 November as Ontvangsdame by ons aangesluit.  Sy het die afgelope ses jaar in die spa- en skoonheids-bedryf gewerk as konsultant, terapeut en administratiewe bestuurder.  Sy was vier jaar in die Sanctuary-groep by onder andere die Twaalf Apostels Hotel en in Mosambiek betrokke.  Sy beskik oor ‘n magdom kennis en ervaring van kliënte-diens.  Ons  vertrou dat haar dienstyd by ons vir haar en vir ons kliënte ‘n besonder aangename ervaring sal wees.

In Januarie 2013 begin die volgende personeel by ons werk:
Cecil Mulligan (Ouditbestuurder) wat aan die einde van 2010 sy klerkskap by ons voltooi het, keer terug na ASL nadat hy ‘n jaar en ‘n half op die Jersey-eilande  vir ‘n groot ouditeursfirma gewerk het. Hy het sy BRek graad in 2006 aan die Noordwes-Universiteit op Potchefstroom voltooi waarna hy na Somerset-Wes verhuis het om sy SAIGR-klerkskap by BGR Aucamp Scholtz (nou Aucamp Scholtz Lubbe) te kom doen. Cecil het in 2008 ‘n BRekHons aan UNISA verwerf en, na suksesvolle voltooiing van die SAIGR-raadseksamens, in 2011 as Geoktrooieerde Rekenmeester geregistreer.

Ivan Theron (Ouditsenior)  het sy klerkskap in 2009 by Griesel Nel  in Pretoria voltooi.  Hy het tydens sy klerkskap sy BRek aan UNISA verwerf en is tans besig met BRekHons, ook aan UNISA.

Joanie Viviers (Professionele Assistent) het in 2007 haar BRekLLB aan die Universiteit van Stellenbosch behaal en daarna in 2007 ‘n BRekHons aan UNISA. Sy het in 2010 haar SAIGR-klerkskap by LDP op Stellenbosch en in Februarie 2012 haar regsklerkskap by Cluver Markotter op Stellenbosch voltooi.  Sy kom na ASL van PWC in Century City waar sy tans as Forensiese Ouditeur werksaam is.

Personeel bly by ons aan
Dit is vir ons aangenaam om aan te kondig dat twee van ons leerlingrekenmeesters en ‘n ouditsenior wie se kontrak tot einde geloop het, besluit het om volgende jaar by ons aan te bly na die voltooiing van hulkontrakte aan die einde van 2012. Ons glo hierdie ontwikkeling is nie net vir ons nie maar ook vir ons kliënte  bemoedigend aangesien dit kontinuïteit van bestaande kliënteverhoudinge verseker.

Corlia van der Merwe en Francois Kritzinger gaan in die ouditafdeling werk en Sumaré Joubert in die kleinsake-afdeling. Dit is vir ons duidelik dat hulle elkeen oor besondere eienskappe beskik wat waarde sal toevoeg tot die huidige spanne en sal bydra tot die voortgesette uitbouing van ons uitmuntende reputasie binne die industrie.

Die ooievaar kuier
Karina en William Roberts het op 25 Oktober 2012 ‘n seun, Paul, ryker geword en Johan, ‘n boetie. Ons is seker dat klein Paul du Toit Roberts vele jare van plesier en vreugde vir hulle sal bring.

Monica Mncube word in Desember 2012 ‘n baba ryker. Ons wens haar alles van die beste toe met die bevalling en in die komende maande.

In die eg verbind
Raubie Brink is op 29 September 2012 met Leandrie getroud en hulle het hulle daarna op Somerset-Wes gevestig. Ons beste wense vergesel hulle op hul huwelikspad.

Verloof geraak
Elizna de Villiers het aan Rudi Hattingh verloof geraak en hulle tree op 27 April 2013 in die huwelik. Hulle gaan hulle daarna op Secunda vestig. Ons wens hulle alle sterkte en voorspoed toe met die troureëlings.

Personeel wat ons verlaat
In die hedendaagse arbeidsmark is personeel baie beweeglik en bemarkbaar en dus is daar ook van ons personeel wat soms groener weivelde soek of deur persoonlike omstandighede genoodsaak word om ons diens te verlaat.

Die volgende persone het gedurende die afgelope paar maande uit ons diens getree of gaan ons aan die einde van 2012 verlaat.  Ons hartlike dank aan elkeen vir hul bydrae in die firma gedurende hul dienstydperk.

Deon van Zyl het sy SAIGR-klerkskap gedurende Augustus voltooi en nadat hy hom eers voltyds aan sy studies toegewy het, het hy onlangs as ‘n Finansiële beplanner in die Kaap begin werk.

Michelle van der Merwe het ook haar SAIGR-klerkskap gedurende Augustus voltooi en het met studieverlof gegaan om haar studies af te handel voordat sy begin om ‘n betrekking te soek.

Shirley Dampies het September haar diens na twee jaar by ASL beëindig om in die Kaap te gaan werk as ‘n persoonlike assistent.

Johan Coetzee het besluit om terug te trek na Namibië en het gedurende November by ‘n ouditfirma in Windhoek begin werk. Windhoek is veel nader aan sy ouerhuis en bied ook vir hom die geleentheid om ondervinding in die mynbedryf op te doen.

Raubie Brink  gaan hom in 2013 by een van ons kliënte, Southern Fruit Growers, aansluit as Finansiële Kontroleerder.

Elsa Benn verlaat ons om nuwe beroepsrigtings te gaan ondersoek.

Elizna de Villiers voltooi haar leerkontrak en verhuis in 2013 na Secunda om by haar verloofde aan te sluit.

Sean Webb voltooi einde Desember sy SAIGR-klerkskap en gaan hom daarna op sy passie, motors, toespits.

Ons wens elkeen van hulle alles van die beste toe vir die toekoms en vertrou dat hulle sukses en voorspoed sal geniet.

Joey Fiford het aan die einde van November afgetree en ons glo ons kliënte sal die verwelkomende glimlag by Ontvangs en die vriendelike stem oor die telefoon, baie mis.  Ons dank haar vir haar bydrae in die firma en wens haar voorspoed en seën toe in haar aftrede.

Department of Labour on the lookout

The Department of Labour is intensifying its efforts to monitor employers’ compliance with legal requirements. Inspectors of the Department are increasingly visiting employers in different sectors and asking pertinent questions to ascertain whether employers are fulfilling their obligations towards the Department.

Employers must therefore make sure that their affairs are in order as far as their relationship with the Department is concerned.

It appears that the spotlight is mostly turned on matters such as:

·    PAYE and UIF registration numbers with SARS – Proof of payments;
·    UIF registration numbers with the Department of Labour – Proof of last UI19 Certificate submitted;
·    Compensation Commissioner registration number with the Department of Labour – Proof of last WAs 8 return submitted and proof of payment in     respect of last  WAs 6 return;
·    Name of Health and Safety Representative; and
·    Employment Equity Plan, if applicable.

Prevention is better than cure. Avoid penalties. Be prepared to see the Department of Labour’s inspector if he/she approaches your business for information.

Departement van Arbeid op die loer

Die Departement van Arbeid wend verskerpte pogings aan om werkgewers se nakoming van wetsvereistes te monitor. Inspekteurs van die Departement besoek in toenemende mate werkgewers in verskillende sektore en vra pertinente vrae om hul te vergewis van die mate waarin werkgewers hul verpligtinge teenoor die Departement nakom.

Dit is derhalwe noodsaaklik dat werkgewers seker moet maak dat hul sake wat hul verhouding met die Departement betref, in orde is.

Dit blyk dat die sake wat meesal onder die soeklig kom die volgende is:

·    LBS- en WVF-registrasienommers by die Suid-Afrikaanse Inkomstediens – Bewys van betalings;
·    WVF-registrasienommers by die Departement van Arbeid – Bewys van laaste UI19 Sertifikaat ingedien;
·    Vergoedingskommissaris-registrasienommer by die Departement van Arbeid – Bewys van laaste WAs 8 opgawe ingedien en bewys van betaling t.o.v. laaste WAs 6 opgawe – Alle werkgewers wat werknemers in diens het vir wie salaris of lone betaal word moet registreer;
·    Naam van die Gesondheid- en Veiligheidsverteenwoordiger; en
·    Gelyke Indiensnemingsplan, indien van toepassing.

Voorsorg is beter as nasorg. Vermy boetes. Wees gereed om die Departement van Arbeid se inspekteur te woord te staan as hy/sy om inligting by u besigheid aanklop.

Boet Lubbe bedank as direkteur

boetBoet Lubbe het besluit om met ingang Januarie 2013 te bedank as ‘n direkteur van Aucamp Scholtz Lubbe. Ons is teleurgesteld dat ons Boet nie langer as ‘n mededirekteur  gaan hê nie maar kan met dankbaarheid meld dat hy steeds, as konsultant, spesialis belastingwerk vir ons en ons kliënte sal verrig en dat sy waardevolle kennis en ervaring dus nie vir ons verlore sal wees nie.

Boet se besluit is grootliks beïnvloed deur die noodsaak om meer permanent by hul groeiende familiebesigheid betrokke  te raak. Hy gaan ook op ‘n meer permanente basis as finansiële adviseur vir van ons kliënte optree.

Ons bedank Boet vir die waardevolle bydrae wat hy gedurende sy dienstydperk in die firma gelewer het, nie net op direksievlak nie. Ons wens hom sukses en veel seën toe vir die pad vorentoe.
